Sir:

        By the provisions contained in paragraphs ten and eleven in special use use permit issued by the Forest Service Feb. 7, 1908 ( approved by Acting Forest Supervisor S. J. Flintham ) to the Yosemite Valley R. R. Co., authorizing the use of certain lands segregated from the Yosemite Park and included in the Sierra (North) National Forest for construction of a diverting dam, pipe line, and water tank to be used for conveying water from a spring and storing it in tank for use in operating the company's railroad constructed to the boundary of the park, the company is required to make payment for all timber used or destroyed in the construction of said dam or pipe line.

        I have to request to be advised as to what, if any, timber has been cut or destroyed by the company on the lands segregate from Yosemite Park under the above permit, together with the value thereof, so that payment may be called for from the company.
